A Legal Question

Just read this article and I have a question for the legal minds out there.

Why does stabbing someone to death, decapitating them and flashing the head around to other people, then eating the corpse's flesh qualify as SECOND degree murder?

maybe because its not premeditated? I'm not a lawyer just watch a lot of Law and Order.

First degree murder is premeditated.

As I understand it, first degree murder is premeditated. Second degree is a "crime of passion".

Regardless, and correct me if I'm wrong, [kreig], but Canada doesn't have the death penalty so the worst this man will get is life imprisonment.

Makes me sad, because from everything I can see about the victim, he was a fairly decent person.

Crazy Canadians and their laws.

In this case though, both a guy acting with premeditation and impulse sound equally terrifying. I'd hope they'd both be jailed for the span of their life.
